These Terms of Use govern access to and use of Choon, including the website, account system, live music discovery tools, venue and artist profile surfaces, event listings, media embeds, messaging or enquiry tools, analytics features, ticket referral pathways, and any related services we provide. By accessing Choon, creating an account, submitting content, claiming a profile, managing a venue, using interactive features, or clicking to accept these Terms, you agree to be bound by these Terms and any policy or notice linked from them, including the Privacy Policy and Copyright page.
If you use Choon on behalf of a venue, artist, company, partnership, association, or other organisation, you represent that you have authority to bind that organisation and that your organisation is also bound by these Terms. If you do not agree, you must not use the service.
Choon is a live music discovery, profile, and event promotion platform. We help fans discover gigs, help artists and venues publish public-facing information, and help account holders manage profile, event, engagement, and referral workflows. Choon is not a legal, financial, tax, booking, ticketing, employment, safety, insurance, or professional advisory service. Information shown on the platform is provided for discovery and operational convenience only and should be checked with the relevant venue, artist, promoter, ticketing provider, or other primary source before you rely on it.
You must provide accurate, current, and complete account information and keep your credentials secure. You are responsible for activity under your account except to the extent caused by Choon's own unauthorised conduct or another matter for which we are legally responsible. You must not misrepresent your identity, age, role, affiliation, venue ownership, artist relationship, booking authority, business authority, verification status, or right to publish content.
Choon may refuse registration, require additional verification, restrict account roles, suspend access, remove permissions, or terminate accounts where we reasonably consider it necessary for security, authenticity, moderation, legal compliance, product integrity, or protection of users and the platform. Users under 18 must use Choon only with consent and supervision from a parent or guardian where required, and must not use features or attend events where doing so would breach age, licensing, venue, or legal restrictions.
You are responsible for the legality, accuracy, rights clearance, and appropriateness of content you submit or make available through Choon, including usernames, artist biographies, venue descriptions, addresses, dates, times, ticket links, booking contacts, ABNs, images, posters, video or audio embeds, gallery material, comments, verification notes, and suggested edits. You must have all rights, permissions, consents, licences, and clearances needed to submit that content and to grant Choon the rights described here.
You retain ownership of your content. You grant Choon a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, communicate, adapt for technical or formatting purposes, distribute, index, promote, analyse, and otherwise use your content for operating, securing, moderating, improving, marketing, and commercialising the service. This licence continues for as long as needed to operate the service, preserve reasonable records, handle disputes, maintain backups, or comply with law. To the extent permitted by law, you consent to Choon doing acts in relation to your content that may otherwise infringe moral rights where those acts are reasonably necessary for ordinary platform operation, formatting, moderation, or promotion.
Artist and venue profiles, gig listings, media embeds, maps, profile claim states, verification indicators, follows, saves, attendance intent, referral counts, and other engagement signals are platform features only. They do not guarantee identity, authority, availability, attendance, ticket inventory, pricing, event quality, commercial results, public safety, legal compliance, or an ongoing relationship between any fan, artist, venue, promoter, ticketing provider, or other party.
Event details can change without notice. You are responsible for checking event times, age limits, venue entry requirements, accessibility, prices, cancellation details, transport, safety conditions, ticket validity, and refund rules with the relevant primary source before attending, performing, publishing, or making business decisions.
Venue onboarding, artist profiles, gig creation, profile claims, ABN verification, approval states, moderation queues, partnership workflows, and analytics dashboards are operational tools. They do not create an employment, agency, partnership, franchise, joint venture, fiduciary, booking, promoter, ticketing, or exclusive commercial relationship unless Choon and the relevant party enter into a separate written agreement that expressly says so.
If you manage a venue or artist profile, you must ensure that public information is accurate, lawful, not misleading, and kept reasonably current. You are responsible for ensuring that your use of Choon complies with consumer law, privacy law, music licensing, venue licensing, workplace laws, advertising rules, tax obligations, and any other obligations that apply to your business or activity.
Some Choon features may be free. Others may be offered as paid subscriptions, promoted placements, venue tools, artist tools, referral products, ticketing integrations, commission arrangements, usage-based features, or other paid services. Where paid services are offered, the applicable price, inclusions, billing cycle, renewal terms, cancellation pathway, taxes, refund rules, and any trial or promotional conditions will be presented at or before purchase and will form part of these Terms.
If a paid service renews automatically, Choon will seek the consent required by applicable law and provide cancellation information with the offer or account controls. Refunds are available where required by law, where specific paid-service terms say they are available, or where Choon chooses to provide one. Unless required by law, refunds are not available merely because a listing receives less engagement than expected, an event changes, a third-party ticketing service changes its terms, or a user fails to use a paid feature.
You must not use Choon to deceive users, impersonate others, publish misleading event or business information, submit infringing material, harass or threaten anyone, discriminate unlawfully, defame others, exploit minors, publish private information without permission, manipulate engagement signals, harvest or scrape data at scale without permission, bypass security controls, reverse engineer restricted systems, interfere with the service, submit malicious code, overload infrastructure, circumvent billing or moderation, or use Choon for unlawful, harmful, misleading, abusive, or commercially damaging activity.
Choon may investigate suspected misuse and may remove content, restrict visibility, preserve records, suspend accounts, terminate access, notify affected parties, or cooperate with law enforcement, regulators, payment providers, infrastructure providers, and rights holders where appropriate.
The Choon service, including software, interface design, layout, branding, logos, copy, graphics, workflows, databases, analytics models, and platform-specific features, is owned by or licensed to Choon and protected by intellectual property and unfair competition laws. Except as permitted by these Terms or by law, you must not reproduce, adapt, distribute, publicly display, extract, frame, decompile, reverse engineer, commercialise, or create derivative works from the service without prior written permission.
Third-party names, logos, images, posters, performances, recordings, venues, ticketing brands, media embeds, and other third-party materials remain the property of their respective owners. If you believe material on Choon infringes your rights, use the Copyright page or contact pathway so we can assess the issue.
Choon may link to or embed third-party services, including ticketing providers, payment processors, maps, analytics tools, social networks, streaming platforms, video platforms, authentication providers, email providers, storage providers, and event sources. Choon is not responsible for third-party content, availability, prices, fees, refunds, data practices, security, service failures, or legal terms. Your use of third-party services is governed by their own terms and policies.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory warranty, right, remedy, or protection that cannot lawfully be excluded, restricted, or modified, including under the Australian Consumer Law. If Choon supplies goods or services to which non-excludable guarantees apply, Choon's liability is limited only to the extent the law allows. These Terms are intended to be read so they do not create unfair contract terms and do not reduce rights that cannot legally be reduced.
To the maximum extent permitted by law, Choon is provided on an as-is and as-available basis. We do not warrant that the service will be uninterrupted, error-free, secure, current, complete, compatible with every device, or free from harmful components. We do not warrant the accuracy of event details, artist lineups, venue details, pricing, ticket availability, referral data, analytics, public-source information, profile claims, or third-party content. We do not guarantee attendance, sales, revenue, ranking, discovery outcomes, referral outcomes, booking outcomes, or commercial success.
To the maximum extent permitted by law, Choon and its officers, employees, contractors, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, punitive, or economic loss, including loss of profits, revenue, goodwill, data, opportunity, attendance, ticket sales, business interruption, or reputation, whether arising in contract, tort, statute, equity, or otherwise. To the maximum extent permitted by law, Choon's total liability for claims connected with the service is limited to the greater of the amount you paid Choon for the relevant paid service in the 12 months before the claim arose or AUD 100. This limitation does not apply where liability cannot lawfully be limited.
To the extent permitted by law, you indemnify Choon against loss, liability, damages, claims, costs, and expenses arising from your content, your misuse of the service, your breach of these Terms, your infringement of third-party rights, your unlawful conduct, your business activities, or your misrepresentation of authority, identity, venue ownership, artist affiliation, event details, or ticketing information. This indemnity does not apply to the extent the relevant loss is caused by Choon's fraud, wilful misconduct, or liability that cannot lawfully be excluded.
Choon handles personal information in accordance with the Privacy Policy. By creating an account, you acknowledge that Choon may send service, security, moderation, account, legal, transactional, and operational communications. Marketing communications, where used, will include opt-out controls where required by law.
Choon may change, suspend, withdraw, or discontinue any part of the service for security, maintenance, legal, moderation, commercial, product, or operational reasons. We may update these Terms from time to time. Updated Terms take effect when published or when otherwise notified. If a change is material and you have an account, we may take reasonable steps to notify you. Continued use after an update takes effect means you accept the updated Terms to the extent permitted by law.
These Terms are governed by the laws of Queensland, Australia, except to the extent mandatory laws in another jurisdiction apply. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and Australia. Before starting formal proceedings, you agree to contact Choon through the contact page and give us a reasonable opportunity to resolve the issue, unless urgent injunctive relief or another legally protected right requires otherwise.
Questions about these Terms, account issues, rights concerns, event corrections, and legal notices can be sent through the Choon contact page. We may need to verify your identity or authority before acting on requests involving accounts, businesses, profiles, private information, or legal rights.
